SCANTICKET PREMIUM SUBSCRIPTION
You can subscribe for unlimited ticket storage with the Premium subscription. Once a premium member you can store and sync all your tickets with all your devices.
- The subscriptions are $3.99 monthly, or $34.99 yearly. A one-time lifetime purchase is also available for $59.99.
- Payment will be charged to iTunes Account at confirmation of purchase
- Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period
- Account will be charged for renewal within 24-hours prior to the end of the current period at the cost of the chosen package
- Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's iTunes Store Settings after purchase
- Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable
- No cancellation of the current subscription is allowed during active subscription period
- ScanTicket Premium Pass is an option and the app can be used for free without it
These Terms and Conditions of Use ("T&Cs") govern the conditions of use of the service offered on the ScanTicket application.
By clicking the "validate" button on the subscription form, you declare that you have effectively read and accepted the T&Cs and are fully aware that you are required to comply with their terms throughout the duration of your registration to the Service.
The T&Cs may be modified at any time by ScanTicket. In such case, ScanTicket will inform you by posting a notice on its website and, in the event of a significant change, will inform you by email.
The modified T&Cs come into force from the date they are published online and are deemed accepted by the mere fact of connecting to the Service.
Any change, generally minor, involving a reduction of your rights under these T&Cs may not be applied without your prior express consent.
The T&Cs may be supplemented by Special Conditions ("SC"), for certain additional service offers. The SC must be accepted and validated at the time of subscription to the relevant services, under the same conditions as the T&Cs.
The SC supplement the T&Cs and form an integral part of the contract concluded between you and ScanTicket. In the event of any contradiction between the documents, the conditions of the T&Cs prevail over those of the SC, unless otherwise provided by the SC.
If one or more of the provisions of the T&Cs is declared invalid, the others will retain their full effectiveness and scope.
Article 1: Definitions
ScanTicket is an application designed by Julien Meyer, Auto-Entrepreneur SIRET: 517 580 437 00013 - NAF: 6201Z, hereinafter referred to as ScanTicket, offering the Service.
Site: The ScanTicket site accessible via the Internet at the address www.scanticket.io and/or at any other address that ScanTicket may add.
User: a person who has accepted the T&Cs and created a ScanTicket user account allowing access to and use of the Service via their Private Area on the application. Private Area: a personalized and secure area, accessible only by the User with their login and password, in which the User can personalize and archive their Personal Content.
Personal Content: all of the personal information archived and uploaded online to their Private Area by the User.
Article 2: Registration and access to the Service
Registration to the Service is reserved for users who are of legal age and legally capable of contracting.
The user undertakes to comply with the laws and regulations in force in France and, where applicable, in their country of residence.
Registration to the Service is done by creating a User account, with a login (a valid email address) and a password. The email address must remain valid for as long as the ScanTicket account remains active and it is the User's responsibility to update it where applicable. More generally, any personal information communicated to ScanTicket that allows the proper functioning of the Service must be updated by the User as soon as it changes.
The password is confidential and the User must under no circumstances communicate it to third parties (individuals or websites). The user may change their password at any time. The User is responsible for all actions carried out on their Private Area with their password, as well as for any losses or damages resulting from such use. The User is solely responsible for the consequences resulting from the communication of their personal login and password to any third party, without prejudice to the damages that ScanTicket may claim due to any harm suffered as a result.
Article 3: Description of the Service
3.1 iPhone Application
ScanTicket provides users, for personal and non-commercial use, a customizable and secure iPhone application, allowing them to archive and remotely consult Personal Content, such as, in particular, receipts, coupons, expense reports and documents in digital format.
The user of the application can personalize their Private Area by adding, modifying or deleting content.
Use of the Service is free within the limit of the storage space made available by ScanTicket of 50 Mo (Megabytes). The User may subscribe to paid additional options, as defined hereinafter and/or offered on the Site.
The Service is provided 24/7 except for the interruption periods necessary for the maintenance of the Service.
The Service is available in French.
3.2 Additional options:
ScanTicket offers the User the possibility to subscribe to paid additional options, as described hereinafter. The price of these options is indicated on the Site. The options may be subject to Special Conditions which the User must accept at the time of subscription.
Storage space increase option
In the event that the User wishes to increase their storage space, they may subscribe at any time to the "Account Plus" option, which offers unlimited storage space (on a maximum basis of 1GB), at the prices and conditions specified on the application, and linked to the integrated PayPal purchase system explained hereinafter.
3.3 Payment:
Payment for the ScanTicket Account Plus service will be made with a valid credit card or PayPal® accounts. The subscription is paid in U.S. dollars. Hereby, you authorize us to charge your credit card for the amounts on a regular monthly or yearly basis starting at the beginning of your subscription and continuing until your account is terminated. If for any reason whatsoever we encounter an inability to make the automatic credit card payment, we will attempt to notify you by email and your subscription will be deactivated until payment is received. Amounts paid for the ScanTicket Plus service, including prepayments, are non-refundable.
Article 4: User conduct and obligations
The user acknowledges that the activity of uploading their Personal Content online, even on their Private Area, engages their responsibility, whether they are the author of it or not. Consequently, they guarantee that their Personal Content is and will remain at all times in compliance with the T&Cs and with the applicable laws and regulations. The user acknowledges that ScanTicket exercises no control over the Personal Content (other than technical if necessary), and may in no case be held responsible for their Personal Content.
In the context of using the Service, the User undertakes to:
Respect the privacy of others, including that of their home service providers and the confidential nature of the information they may receive;
Not usurp anyone's identity by any means whatsoever, and in particular by using their email address and password;
Always provide their personal data and information accurately, sincerely and truthfully, and update this data and information as soon as it proves necessary so that it remains accurate, complete and up to date;
Not upload or share content or behave in a way that would cause the interruption, would constitute a hindrance, would destroy, or, more generally, would disrupt the functioning of the Site and/or the Service or would allow unauthorized access to the Site, in particular by using any viruses, insidious lines of code, programs or files;
Not reproduce, copy, sell or make commercial use (including with regard to the right of access) of all or part of the Service and/or the Site.
Hold the rights and authorizations, including those of third parties, necessary for the storage of their Personal Content and more generally for the use of the said Service.
Not upload, share, or communicate in any way whatsoever any Content that is obscene, defamatory, insulting, threatening, of a child pornographic nature, glorifying war crimes or crimes against Humanity, directly provoking acts of terrorism, violating the privacy of others and/or unlawful in any way whatsoever;
In the event of a breach of the User's obligations, ScanTicket reserves the right, at its sole discretion, to delete the User account and/or refuse access to the Site, as well as to disclose any information that may be necessary in order to comply with any laws, regulations, decrees, or with a request from a competent authority.
Furthermore, the User indemnifies ScanTicket against any recourse or action (including the associated attorney's fees) that any third party may bring as a result of the use of the Service, the breach of the T&Cs and any other contractual document, or, more generally, the violation of the law.
The user accepts the presence of advertising and promotional spaces on the Site and in particular in their Private Area.
The User explicitly acknowledges being informed that the documents archived electronically in the Private Area may not replace the originals in paper or electronic format and that they must therefore keep them, and this, for the documents concerned, within the time limit provided for by Law.
Article 5: ScanTicket's obligations
The purpose of ScanTicket is to offer a secure space for archiving personal information, viewable online by Users who have installed the iPhone application.
ScanTicket undertakes to:
Host the Personal Content uploaded online by the User within the limit of 50 Mo (Megabytes) or, where applicable, within the limit of the additional storage option subscribed to by the User.
Keep confidential the information uploaded online in the User's Private Area, as specified hereinafter.
ScanTicket may in no case replace the User's possible obligation to keep their personal documents in original, paper or electronic format.
ScanTicket may send the User notifications by email, in particular to inform them of developments in the Service.
ScanTicket reserves the right to modify all or part of the Site at any time and without notice. ScanTicket may not be held responsible for the consequences of any modifications, interruptions or deletions occurring on the Site.
ScanTicket reserves the right to set up technical barriers limiting the number, type and/or size of Personal Content in order to limit any abusive or improper uses of the Service. The User will be informed by email of the technical limitations made to the use of the Service.
ScanTicket grants no express or implied warranty, as to the use of the Service and in particular as to its availability, its timely, current, reliable and useful character.
Article 6: Duration / Suspension / Termination of the Service
Subscription to the Service takes effect from the User's registration, for an indefinite period.
6.1 Termination at the User's initiative
The User may close their account at any time and without reason.
The closure of the account takes effect definitively at the moment the user deletes their account. Their personal content will be definitively lost. To delete their account, the user will send an email in the appropriate menu of the iPhone application. Otherwise the user may write directly to this email address: theteam@themedializers.com.
ScanTicket may return the Personal Content to any person justifying their capacity to that effect (for example as an heir, etc.).
6.2 Termination at ScanTicket's initiative
In the event of a breach of the T&Cs and after formal notice by email that has gone unanswered within a period of 15 days, ScanTicket reserves the right to limit the User's access to the Site and/or to delete the account.
In the event of non-use of the Private Area (that is to say without access by the User to their Private Area) for a period of 6 months, ScanTicket may, 15 days after a reminder sent by email to the email address of the User account that has remained without effect, unregister the User and delete their Private Area.
In the event of non-payment of the paid additional storage space at the end of the one-year period, and of failure to return to the free storage limit size, ScanTicket reserves the right to unregister the User and to delete their Private Area.
Failing to retrieve their own Personal Content before their unregistration, the User's Personal Content will be destroyed without them being able to claim any compensation on any grounds whatsoever.
Article 7: Intellectual and industrial property rights
The trademarks and the content, in particular the texts, software, sound documents, photographs and drawings that appear or are available on the Site and the Service, are protected by intellectual and industrial property law and are the exclusive property of ScanTicket and/or its partners. The User undertakes, without this list being limiting, not to use, reproduce, represent, distribute, adapt or borrow content of the Service for a use other than that strictly limited to the use of the Service in accordance with the T&Cs, except with the express and written authorization of ScanTicket and/or its partners.
The Personal Content stored on the Private Area by the User remains the full and exclusive property of the User. In no way may ScanTicket claim any right over all or part of the said Personal Content.
Article 8: Liability
The User is responsible for the use of their login and their password. Any uses of the Service and uploading of Personal Content carried out using the login and the password will be deemed to have been carried out by the User. In particular, ScanTicket may not be held responsible for the content of the archived documents and information because ScanTicket exercises no control, other than possibly technical, over the documents that are archived on the Private Area.
The User acknowledges and accepts that the Internet network or any other network used for the purpose of transmitting the Personal Content may be saturated and/or that the data exchanged via the network may be intercepted and consequently, the User releases ScanTicket from any liability in this regard.
ScanTicket's liability may not be engaged on any grounds whatsoever, and without this list being limiting, in the event of use by a third party of the login and the password nor in the event of modification, suspension or interruption of the Service.
Likewise, ScanTicket's liability may not be engaged due to the interference of third parties in the communication and transmission systems that the User uses or due to malfunctions or stoppages of the Service due to negligence, faults or any act on the part of the User or a third party.
ScanTicket may in particular not be held responsible for any failure during the reception of data, where such failures result from the filtering, blocking and/or interruption techniques of the networks for accessing the Service put in place by technical intermediaries, such as access providers, external to the Contract.
ScanTicket may not be held responsible for the consequences, including financial, that could result from the loss of Personal Content due for example to a failure of the Internet network or to the computer configuration of the equipment used to access the Service and over which ScanTicket exercises no control.
ScanTicket informs the User that it is required to cooperate with any duly mandated judicial authority to provide any required information, whether it concerns the User themselves and/or the Personal Content, to monitor or even eliminate information contrary to the regulations in force.
The User is informed and accepts that all or part of the Service may, for reasons of repair, development or maintenance, be momentarily interrupted. ScanTicket may not be held responsible for the consequences resulting from any interruption linked to maintenance or development operations.
The User acknowledges having received complete information online about the Service and subscribing to it with full knowledge of the facts. In no case may ScanTicket's liability be engaged for indirect damages and in particular any commercial, moral or financial harm including any loss of profits or loss of brand image having as its cause, origin, or basis, the use of the Service.
ScanTicket may not be held responsible for the partial or total non-performance of its obligations due to an event of force majeure, and in particular, in the event of blockages or failures of telecommunication networks, insurrections, civil war, war, military operations, national or local state of emergency, fire, lightning, flood, explosion, strike, storm, act of a third party, etc.
Article 9: Personal information
The personal data necessary for the User's registration is intended for ScanTicket and is necessary for the provision of the Service. The User undertakes to provide accurate and complete data, and to update it as often as necessary.
ScanTicket also collects the traffic data that is generated when the User's computer is connected to the Internet and to the Site and which, on their own, do not allow them to be identified. ScanTicket collects this data relating to the connection and use of the Service for statistical and non-nominative use, with the aim of improving the Service.
ScanTicket may store "cookie" files on the User's hard drive in order to record their profile and restore their personalized pages of the Site when they are connected via their usual computer. These small files may contain, for example, the User's traffic data and preferences. They are also used in the context of advertising services, in order to help advertisers and publishers display and manage their ads on the web. The User may delete cookies and configure their browser software in order to oppose the recording of cookies on their computer. Some ScanTicket features and services may not work properly if cookies are disabled.
The Users' personal data is used by ScanTicket for the sole purposes of providing the Service. The data collected is strictly confidential and may not be disclosed to third parties, except in the event of the User's express agreement or in the event of a requisition by the judicial or administrative authorities.
ScanTicket may transmit certain personal information relating to Users to its subcontractors bound by an obligation of confidentiality, and who will only be authorized to use it for the sole purposes of providing the Service.
ScanTicket may send emails to the User, at the address associated with their account, to communicate technical or administrative information to them or to inform them of the development of ScanTicket Services.
Any other use by ScanTicket of the User's personal data will be carried out with the User's prior agreement.
The information collected is kept for the entire duration during which the User is registered to the Service. In the event of the User's unregistration, in the manner provided for in the T&Cs, the information collected will be destroyed within a period of one (1) month after unregistration from the Service.
At any time the User may request by email to theteam@themedializers.com that their account be closed and that all associated personal data be erased.
ScanTicket undertakes to implement the appropriate technical and organizational measures to ensure the security and confidentiality of the Users' personal data.
In accordance with the French Data Protection Act (loi Informatique et Libertés n°78-17 of 6 January 1978), Users have a right of access, rectification and deletion of the personal information concerning them, either in the "my account" section of their Private Area or by writing to theteam@themedializers.com.
Article 10: Assignment
ScanTicket reserves the right, after having informed the User, to transfer its rights and obligations under the T&Cs and the contract, subject to the assignee's commitment to comply with the terms of these T&Cs.
Article 11: Applicable Law – Disputes
The T&Cs, as well as the relations with ScanTicket, are governed, interpreted and applied in accordance with French law. All disputes related to, or arising from, the use of the Site or the Service will be subject to the exclusive jurisdiction of the French courts.
